Cazual Terms and Conditions

1. About Cazual

Cazual (Pty) Ltd (“Cazual”, “we”, “our”, or “us”) is a South African company providing a local link-in-bio, commerce, and analytics platform for creators, musicians, and businesses. We operate primarily under South African law.

2. Eligibility & Account Registration

• You must be at least 18 years old or have the legal capacity to enter into contracts in South Africa.
• You must provide accurate, complete, and updated information during registration and keep your login credentials secure.
• You are responsible for all activities that occur under your account.
• We may suspend or terminate your account if we detect misuse, unlawful behaviour, or breach of these Terms.

3. Acceptable Use

You agree not to:

1. Upload or share content that is illegal, defamatory, hateful, harassing, fraudulent, or infringes intellectual property rights.
2. Misrepresent your identity or affiliation, or impersonate any person or entity.
3. Use automated scripts, bots, or scrapers without our written permission.
4. Distribute malware, attempt unauthorized access, tamper with security measures, or overload our infrastructure.
5. Collect or process personal data obtained through the Platform in violation of POPIA or other data protection laws.
6. Sell, resell, or exploit the Platform for unauthorized commercial purposes.

We may remove content or suspend accounts that violate these requirements or harm the Cazual community.

4. Plans, Billing & Payments

• Pricing and plan features are described on the Platform. All prices are denominated in South African Rand (ZAR) and include VAT where applicable.
• Paid plans renew automatically at the end of each billing cycle unless cancelled.
• You authorize us (and our payment partners such as PayFast) to charge the payment method on file.
• You may cancel at any time; cancellations take effect at the end of the current billing period. Fees are non-refundable unless required by law.
• Downgrading plans may result in loss of features or access to certain data.

5. Commerce & PayFast Integration

1. You must provide accurate product descriptions, pricing, refund policies, and comply with applicable consumer-protection laws.
2. You are responsible for taxes, shipping, and customer support relating to your offerings.
3. PayFast or other integrated gateways act as independent processors; you must also accept their Terms.
4. You may not sell prohibited goods or services (e.g., illegal substances, weapons, explicit adult content, or items restricted by law).

6. Intellectual Property

• You retain ownership of content you upload. By posting content you grant Cazual a worldwide, non-exclusive, royalty-free licence to host, display, and distribute the content solely to operate the Platform.
• Our trademarks, branding, and software are owned by Cazual. You may not copy or modify our intellectual property without written permission.
• We may showcase public profiles in promotional materials unless you opt out via support.

7. Data Protection & Privacy

We process personal data according to our Privacy Policy. By using the Platform you consent to such processing. You must comply with POPIA and other applicable data-protection laws when handling visitor or customer data collected through your profile.

8. Availability & Service Levels

We aim to provide a reliable service but do not guarantee uninterrupted availability. Scheduled maintenance, updates, or unforeseen outages may temporarily affect access. We will provide notices for significant downtime where practicable.

9. Disclaimers

The Platform is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, Cazual disclaims all warranties, whether express or implied, including merchantability, fitness for a particular purpose, accuracy, or non-infringement. Use the Platform at your own risk.

10. Limitation of Liability

To the maximum extent permitted by law, Cazual is not liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits, data, goodwill, or business interruption. Our total liability for any claim arising out of these Terms will not exceed the amounts paid by you to Cazual in the twelve (12) months preceding the claim. Nothing in these Terms excludes liability that cannot be excluded under South African law.

11. Indemnity

You agree to indemnify and hold harmless Cazual, its directors, employees, and partners from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Platform, your breach of these Terms, or content/products you publish or sell through Cazual.

12. Suspension & Termination

We may suspend or terminate access if:

• You violate these Terms or applicable law.
• We detect fraudulent activity or security risks.
• Required by court order or regulatory instruction.

You may terminate your account at any time through the dashboard or by contacting support@cazual.co.za. Certain obligations (e.g., outstanding fees, indemnity, confidentiality) survive termination.

13. Changes to the Terms

We may update these Terms from time to time. Material changes will be communicated through email or dashboard notifications. Continued use after the effective date constitutes acceptance of the revised Terms.

14. Governing Law & Dispute Resolution

These Terms are governed by South African law. Parties agree to the exclusive jurisdiction of the courts of the Republic of South Africa. Before instituting formal proceedings, please contact our support team to attempt amicable resolution.
